For over two decades, we have fought to protect the privacy and to secure all data related to our guests and registered users. We believe in, and strongly defend the protections of the United States Constitution, and strive to maintain a trusted platform for the free and unfettered self-expression of our users. To help achieve this goal, we have created this transparency report and proudly participated in the original Canary Watch program at CanaryWatch.org. That program has been discontinued, but our commitment to your privacy has never changed. We intend to keep our canary status posted below and we will vigorously defend the rights of our users:

As of November 8th, 2024, Clever Things, LLC has not received any Foreign Intelligence Surveillance Act (FISA) Court orders of any type, and we have not been subject to any gag order by a FISA court, or any other similar court of any government.

As of November 8th, 2024, Clever Things, LLC has not received any subpoenas and/or search warrants accompanied by a gag order pursuant to the Electronic Communications Privacy Act.

As of November 8th, 2024, Clever Things, LLC has not any other legal process that would prohibit us from disclosing its receipt to the public.

To safeguard our sensitive user and business data, Clever Things, LLC has developed a very strict corporate Security Practices Policy. Clever Things, LLC has no knowledge of, and has never placed any backdoors in our hardware, firmware, or software, and has never received any requests to do so.

Pursuant to our Privacy Policy, Clever Things, LLC has never disclosed any privileged user communications to any third party.

Notice of Violations:

A notice will be sent to each user whose content is taken down or account is suspended about the reason for the removal or suspension:

  • We provide detailed guidance to the community about what content is prohibited, including examples of permissible and impermissible content and the guidelines used by reviewers.
  • We use automated detection across each category of content to prevent spam and abuse.
  • We provide the user with notice about why their post has been removed or an account has been suspended.
  • We provide the URL, content excerpt, and/or other information sufficient to allow identification of the content removed.
  • We provide the specific clause of our guidelines that the content was found to violate.
  • We provide a description of how the content was detected and removed (flagged by other users, governments, trusted flaggers, automated detection, or external legal or other complaint).
  • The identity of individual flaggers will not be revealed, however, content flagged by government will be identified as such, unless prohibited by law.
  • We provide an explanation of the process through which the user can appeal the decision (see below).
  • We provide notices in a durable form that is accessible even if a user’s account is suspended or terminated.
  • Users who flag content are presented with a log of content they have reported and the outcomes of moderation processes.

Appeals:

We provide a meaningful opportunity for the timely appeal of any content removal or account suspension:

  • Request a human review by a person or panel of persons that was not involved in the initial decision.
  • An opportunity to present additional information that will be considered in the review.
  • Notification of the results of the review, and a statement of the reasoning sufficient to allow the user to understand the decision.
